Terms for Organizers

Version of 12.10.2026

These Terms set out the rules for using the BailaCon platform by organizers of dance competitions and events and by dance schools. The Data Processing Agreement forms an integral part of these Terms. In case of discrepancies, the Polish version prevails.

§1. General Provisions and Definitions

  1. Provider — Percatech Arkadiusz Okoń, ul. Żarnowiecka 12, 43-100 Tychy, Poland, tax ID (NIP): 9542578680, REGON: 365784102, email: arkadiusz.okon@gmail.com, the operator of the BailaCon platform.
  2. Organizer — a business or other entity (including a dance school, association or foundation) for which the Provider has created an Organizer Account and which uses the Platform in connection with its activity.
  3. Platform — the BailaCon system: the Panel, the mobile app, school and event websites and related services.
  4. Panel — the browser-based administration panel in which the Organizer manages its competitions, events and school.
  5. Participant — a person using the Organizer's services (a competition or event participant, a school student).
  6. Staff — persons to whom the Organizer has granted access to the Panel (e.g. instructors, reception, judges).

§2. Conclusion of the Agreement

  1. The Organizer Account is created by the Provider. The agreement for services under these Terms is concluded when a person representing the Organizer accepts them in the Panel.
  2. The person accepting the Terms declares that they are authorized to represent the Organizer. The Provider records the date of acceptance, the version of the documents and the details of the accepting person, and sends a confirmation to their email address.
  3. The Organizer is not a consumer — it uses the Platform in the course of its professional activity.

§3. Scope of Services

  1. The Platform enables the Organizer in particular to: run competitions and events (registrations, start lists, judging, results, sales), run a dance school (courses, schedule, passes, reception and attendance records, shop, communication with students), publish a school or event website and accept payments through a payment operator.
  2. The available functionality may depend on the purchased package or individual arrangements with the Provider.
  3. AI-based features (e.g. generating descriptions, schedule proposals) are optional. Their results are auxiliary — the Organizer is responsible for reviewing them before publication or use.

§4. The Provider's Role Towards Participants

  1. The Organizer is the sole party to agreements concluded with Participants (competition or event participation, courses, passes, purchases). The Provider acts as a technology provider and technical intermediary and is not a party to those agreements.
  2. Participants' payments are paid directly into the Organizer's account with the payment operator, with which the Organizer concludes its own agreement. The Provider does not receive, hold or settle Participants' funds.
  3. The Organizer is liable towards Participants for the performance of its services, including handling complaints, refunds, the right of withdrawal and issuing receipts and invoices.

§5. Regulations for Participants

  1. The Platform adds system sections (including the Organizer's details, payments, right of withdrawal, data protection and complaints) to the regulations of every school, competition and event. The Organizer cannot remove them but may add its own sections.
  2. The system sections are a template prepared with due care but do not constitute legal advice. The Organizer is responsible for the content of its own sections and for the compliance of the whole regulations with its activity and the law.
  3. The Organizer's details entered in the Panel (company name, address, tax ID, email) are shown to Participants as the details of the party to the agreement. The Organizer undertakes to keep them complete and up to date.

§6. Organizer's Obligations

  1. The Organizer undertakes to use the Platform in accordance with the law, in particular consumer protection and data protection laws, and not to post unlawful content or content infringing third-party rights.
  2. The Organizer keeps its access credentials confidential, grants Staff access only to the extent necessary and is liable for the actions of its Staff in the Panel as for its own.
  3. The Organizer does not enter special categories of data (Article 9 GDPR, e.g. health information) into the Platform unless this is necessary and it has a legal basis to do so.
  4. The Organizer promptly informs the Provider of any suspected unauthorized access to its account.

§7. Fees

  1. Fees for using the Platform (e.g. competition credits, school module subscription) are set out in the current price list or in individual arrangements with the Provider.
  2. Fees charged by the payment operator on Participants' transactions arise from the Organizer's agreement with that operator and are not fees payable to the Provider.

§8. Availability and Liability

  1. The Provider makes efforts to ensure that the Platform operates continuously and securely, subject to technical breaks, which it announces in advance where possible.
  2. The Provider is not liable for damage caused by payment operators, internet providers and other third parties beyond its control, or for the consequences of the Organizer entering untrue or outdated data.
  3. The Provider's liability towards the Organizer is limited to actual damage and to the amount of fees paid by the Organizer in the 12 months preceding the event causing the damage. This limitation does not apply to damage caused intentionally.

§9. Personal Data

  1. With regard to the data of Participants and Staff that the Organizer keeps in the Platform, the Organizer is the controller and the Provider is the processor. The rules of such processing are set out in the Data Processing Agreement, concluded together with the acceptance of these Terms.
  2. The Provider processes the data of BailaCon app user accounts (including persons representing the Organizer) as a controller — in accordance with the Privacy Policy and the Information Clause.

§10. Term and Termination

  1. The agreement is concluded for an indefinite period.
  2. Either party may terminate the agreement with 30 days' notice, by email.
  3. The Provider may terminate the agreement with immediate effect and block the account if the Organizer seriously breaches these Terms or the law, in particular uses the Platform for unlawful purposes.
  4. After termination, the data entrusted by the Organizer is returned or deleted in accordance with the Data Processing Agreement. This does not affect the Organizer's obligations towards Participants arising before termination.

§11. Changes to the Terms

  1. The Provider may change these Terms or the Data Processing Agreement for important reasons, in particular changes in the law, the scope of services or sub-processors.
  2. The Provider informs the Organizer of changes by email or in the Panel at least 14 days before they take effect. The new version requires acceptance in the Panel. An Organizer who does not accept the changes may terminate the agreement with effect on the date they take effect.

§12. Final Provisions

  1. The agreement is governed by Polish law.
  2. Disputes are resolved by the court competent for the Provider's registered office.
  3. Questions concerning these Terms may be sent to: arkadiusz.okon@gmail.com.
