These Terms of Service define the rules for using the BailaCon application and website.
1. General Provisions
The owner and administrator of the BailaCon service is Percatech Arkadiusz Okoń with its registered office at 43-100 Tychy street Żarnowiecka 12, NIP (Tax ID): PL9542578680.
Terms used in these regulations mean:
- Service/Application: the BailaCon IT platform available as a mobile application and website.
- User: a natural person using the Service.
- Organizer: an entity organizing a dance competition or event via the Service.
- Participant: a User taking part in a competition or event.
- School: an entity running a dance school or dance classes, using the Service to manage courses, schedules, passes, sales, and communication with students.
- Student: a User enrolled in a course or classes run by a School.
- Pass: an entitlement to attend a School's classes (a specific number of entries and/or validity period), purchased via the Service or directly at the School.
2. Technical Requirements
To use the Service, it is necessary to have:
- A device with Internet access.
- The BailaCon mobile application installed (Android/iOS) or a web browser.
- An active email account.
3. Role of BailaCon
BailaCon is a technology platform (marketplace/SaaS) enabling Organizers to manage competitions and events, Schools to manage courses, classes, passes, and sales, and Users to register, enroll, and track results and progress.
BailaCon is not the organizer of events nor the provider of classes available in the Service (unless explicitly stated otherwise). The agreement regarding participation in an event is concluded directly between the Participant and the Organizer, and the agreement regarding participation in courses, classes, or the purchase of a Pass — directly between the Student and the School.
4. Dance Schools and Classes
The Service enables Schools to run a school profile and manage courses and classes. Within these features:
- Enrollment in courses and classes: a Student may enroll on their own in the Application (if the School enables this option for a given course) or be enrolled by the School. The number of places in groups may be limited.
- Class schedule: dates, rooms, and instructors are published by the School. The School may cancel classes, arrange substitutions, and change times and rooms — the Service communicates such changes, but the School is responsible for organizing the classes.
- Attendance records: class entries may be registered at the School's reception, e.g., by scanning the Student's individual QR code from the Application.
- Passes: pass types, prices, number of entries, and validity periods result from the offer of the given School. A Pass is personal and entitles the holder to attend classes in accordance with its terms.
- Partner cards (e.g., Multisport, Medicover Sport): acceptance of cards and any surcharges are determined by the School. Registering an entry with a partner card may require verification of the card number and a check-in in the card operator's system.
- School shop and on-site sales: the School may sell products (e.g., beverages) and services via the Service. The seller is the School, and it issues receipts or invoices where required by law.
- Reviews and surveys: a Student may voluntarily leave a review of the School or complete a survey. Posting unlawful, offensive, or false content is prohibited; the School may disable the reviews module, and the Administrator may remove content violating these Terms.
- Image during classes: classes may be photographed or recorded for the School's promotional purposes — detailed rules, including the basis and scope of image use, are specified in the regulations of the given School.
5. Payments and Orders
The Service enables payments for tickets, registration fees, Passes, and purchases in the School's shop via the Tpay payment operator. Selected Schools may additionally accept cash or card payments on site; some Schools accept electronic payments only (Tpay), which they communicate on site.
- The User is obliged to pay for the order within the time limit specified by the Organizer or the School (usually counted in hours from the moment of booking).
- Failure to pay within the specified time results in automatic cancellation of the reservation/registration, and in the case of a Pass — in its non-activation.
- On-site payment may be made by scanning a QR code with a Tpay payment link presented by the staff.
- Invoices for participation in events are issued by the Organizer of the given event; receipts and invoices for Passes, classes, and shop purchases are issued by the School.
6. Withdrawal and Refunds
In accordance with Article 38 point 12 of the Consumer Rights Act, the right to withdraw from a distance contract does not apply to the consumer in relation to contracts for the provision of services related to entertainment, sports, or cultural events, if the contract specifies the day or period of service provision.
In the event of cancellation of an event by the Organizer, refunds are made on the terms specified by the Organizer.
Rules for Pass refunds, making up missed classes, and handling cancelled classes are specified in the regulations of the given School. The School's regulations do not exclude consumer rights arising from generally applicable law.
7. User Account
The User may delete their account at any time using the appropriate function in the application or on the website. Account deletion is irreversible. Deleting the account does not affect settlements previously made with a School or Organizer, nor the data processed by the School or Organizer as separate controllers.
8. Image
By registering for a competition, the Participant acknowledges that events may be recorded (photo/video) and broadcast. Detailed rules for the use of the image are specified in the regulations of the specific event provided by the Organizer.
The application may require uploading a profile picture with a visible face to verify the Participant's identity during competitions and to identify the Student at the School's reception.
9. Complaints
Complaints regarding the operation of the Application itself should be reported to: arkadiusz.okon@gmail.com.
Complaints regarding the course of events, judging, or venue conditions should be directed directly to the Organizer of the given event.
Complaints regarding classes, Passes, attendance records, or shop purchases should be directed directly to the given School.
10. Final Provisions
The Administrator reserves the right to change the Regulations. Users will be informed about changes in the Application.
